End User License Agreement (EULA)

This End User License Agreement ("Agreement") applies to your use of the Do app (the "Licensed Application"). It is concluded between you and the developer of Do (the "Licensor"), and not with Apple Inc. ("Apple"). The Licensed Application is distributed via the Apple App Store and is also subject to Apple’s Licensed Application End User License Agreement; where they conflict, the terms more favorable to you prevail. By downloading or using the Licensed Application, you agree to this Agreement.

1. Scope of license

Licensor grants you a non-transferable license to use the Licensed Application on any Apple-branded products that you own or control and as permitted by Apple’s Usage Rules. The license is a non-exclusive, limited, revocable license for personal use. You may not distribute the Licensed Application or make it available over a network where it could be used by multiple devices at once, except as allowed by Apple Family Sharing or volume purchasing.

2. Restrictions on use

Except as expressly permitted by applicable law, you may not:

  • ·copy, modify, translate or create derivative works of the Licensed Application;
  • ·reverse engineer, decompile, disassemble or otherwise attempt to derive the source code;
  • ·rent, lease, lend, sell, sublicense or otherwise distribute the Licensed Application;
  • ·remove, obscure or alter any proprietary rights notices or labels.

3. Maintenance and support

Licensor is solely responsible for any maintenance and technical support for the Licensed Application (where offered). Apple has no obligation whatsoever to furnish any maintenance and support. For support, contact us at support@xiaoyehua.dev.

4. Warranty

Licensor is solely responsible for any product warranties (to the extent warranties are offered). If the Licensed Application fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the Licensed Application; to the maximum extent permitted by law, Apple has no other warranty obligation, and any other claims, losses, liabilities or expenses are the responsibility of Licensor.

5. Product claims

Licensor, not Apple, is responsible for addressing any claims by you or a third party relating to the Licensed Application or your possession and use of it, including but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation.

6. Intellectual property

If a third party claims that the Licensed Application or your possession and use of it infringes its intellectual-property rights, Licensor, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such infringement claim.

7. Legal compliance

You represent that (i) you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties. You agree to comply with all applicable local and international laws in using the Licensed Application.

8. Third-party beneficiary

You agree that Apple and its subsidiaries are third-party beneficiaries of this Agreement, and that upon your acceptance, Apple will have the right (and is deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary.
